Frequently Asked Questions

Who must consent to the S election?
All shareholders (and certain spouses in community property situations) must consent. Missing consents are a common reason elections fail or need relief.
When is Form 2553 due?
Generally no more than two months and 15 days after the beginning of the tax year the election is to take effect, or at any time in the preceding tax year. Late election relief may be available under IRS procedures.
